Terms & Conditions

Welcome to Play Pop ("we," "us," "our"), a playspace and family club located in New York State and operated online at playpop.co (the "Site"). By accessing or using our Site, booking services through our third-party booking platform (Sawyer), or visiting our physical location, you ("you," "your," or "Member") agree to be bound by these Terms & Conditions ("Terms"). If you do not agree, please do not use our Site or services.

1. Eligibility

Our services are designed for families with children. You must be at least 18 years of age to create an account, purchase a membership, or book services on behalf of a minor. By using our services, you represent that you meet this age requirement and have the legal authority to agree to these Terms.

2. Membership

Play Pop operates on a monthly membership model. By subscribing to a membership, you agree to the following:

Recurring Billing. Membership dues are billed on a recurring monthly basis through our booking platform, Sawyer. By enrolling, you authorize us (via Sawyer) to charge your selected payment method each billing cycle until you cancel.
Membership Benefits. Active members receive access to our playspace and any member-exclusive programming, events, or perks as described on the Site at the time of enrollment. Benefits may change from time to time at our discretion.
Cancellation. You may cancel your membership at any time through your Sawyer account or by contacting us directly. Cancellation takes effect at the end of the current billing period. No partial-month refunds will be issued.
Price Changes. We reserve the right to adjust membership pricing with at least 30 days' written notice (via email or the Site). Continued membership after the effective date of a price change constitutes acceptance of the new pricing.

3. Booking & Payments

All bookings, transactions, and account management are processed through Sawyer, a third-party platform. By making a purchase, you also agree to Sawyer's own terms of service and privacy policy. Play Pop is not responsible for Sawyer's platform availability, payment processing errors, or data handling beyond what is described in our Privacy Policy.

4. Club Rules & Code of Conduct

When visiting our playspace, all members and guests agree to abide by our club rules and code of conduct as outlined on our website at playpop.co. These rules include, but are not limited to, guidelines on child supervision, safety, hygiene, and respectful conduct. We encourage all members to review these rules in full before visiting.

We reserve the right to revoke membership or deny entry to anyone who violates our club rules, engages in unsafe behavior, or disrupts the enjoyment of other members, without refund.

5. Assumption of Risk & Liability Waiver

Physical play carries inherent risks including, but not limited to, slips, falls, bumps, and minor injuries. By entering our playspace or allowing your child to participate in activities, you acknowledge and voluntarily assume these risks.

To the fullest extent permitted by New York State law, Play Pop, its owners, employees, and agents shall not be held liable for any injury, loss, or damage arising from the use of our playspace, equipment, or participation in any activities, except in cases of gross negligence or willful misconduct on our part.

We may require you to sign a separate waiver of liability before your first visit.

6. Intellectual Property

All content on the Site — including text, graphics, logos, images, and software — is the property of Play Pop or its licensors and is protected by applicable intellectual property laws. You may not reproduce, distribute, or create derivative works from our content without prior written consent.

7. User Accounts

You are responsible for maintaining the confidentiality of your Sawyer account credentials and for all activities that occur under your account. You agree to notify us immediately of any unauthorized access or use of your account.

8. Limitation of Liability

To the maximum extent permitted by law, Play Pop's total liability to you for any claims arising out of or related to these Terms or our services shall not exceed the total membership fees paid by you in the three (3) months immediately preceding the event giving rise to the claim.

9. Indemnification

You agree to indemnify and hold harmless Play Pop, its owners, officers, employees, and agents from any claims, damages, losses, or expenses (including reasonable attorneys' fees) arising out of your use of our services, your violation of these Terms, or your conduct at our playspace.

10. Modifications to These Terms

We may update these Terms from time to time. When we do, we will revise the "Effective Date" at the top of this page and, for material changes, notify members via email. Your continued use of our Site or services after any changes constitutes acceptance of the updated Terms.

11. Governing Law & Dispute Resolution

These Terms are governed by and construed in accordance with the laws of the State of New York, without regard to its conflict-of-law principles. Any disputes arising under these Terms shall be resolved exclusively in the state or federal courts located in New York State.

12. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.
